Terms of Use

Welcome to Kiwi & Friends. These Terms of Use govern your access to and use of the KiwiLights app and the Kiwi & Friends website (collectively, the "Service"), both operated by Sahtu Press, Inc. ("we," "us," or "our"). By using the Service, you agree to these terms.

1. Eligibility & Parental Consent

The Service is intended for general audiences. If you are under 13 years of age, you may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. By allowing a child to use the Service, the parent or guardian accepts these Terms in full.

In-app purchases and subscription sign-ups require an Apple ID, which requires the account holder to be at least 13 years of age (or the applicable age of majority in your region).

2. The App & Website

KiwiLights is a nightlight and companion app available on the Apple App Store. The Kiwi & Friends website provides stories, character information, wallpapers, and related content. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. Subscriptions & In-App Purchases

KiwiLights offers optional in-app purchases and auto-renewing subscriptions (KiwiLights Plus) that unlock premium features. All purchases are processed by Apple via the App Store and are subject to Apple's Terms of Sale. We do not handle payment information directly.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your Apple ID account settings. Refund requests are handled by Apple — we have no control over refund decisions.

4. Yooka the Bedtime Buddy

KiwiLights includes Yooka, the bedtime bot Kiwi built as part of the app's story. Yooka's voice lines are pre-recorded audio clips bundled with the app. Although Yooka is a "bot" inside the story, Yooka is not a chatbot, not a live AI, and not a conversational service. The app does not send any user input to a language model, voice service, or external AI provider at runtime.

Yooka's pre-recorded lines are intended for entertainment, comfort, and bedtime companionship only. They are not a substitute for professional advice of any kind — medical, psychological, educational, or otherwise.

5. Intellectual Property

All content within the Service — including but not limited to character designs, names, stories, artwork, animations, sounds, and the Kiwi & Friends brand — is owned by or licensed to Sahtu Press, Inc. and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Service without our prior written permission. Wallpapers provided for download are licensed for personal, non-commercial use only.

6. User Conduct

You agree not to: use the Service for any unlawful purpose; attempt to reverse-engineer, decompile, or extract the source code of the app; scrape or harvest content from the website; transmit harmful, offensive, or inappropriate content through any input feature; or attempt to circumvent subscription or feature restrictions.

7. Newsletter

By subscribing to our newsletter, you consent to receive periodic emails from Sahtu Press about Kiwi & Friends. You can unsubscribe at any time via the link in any email we send. We will not share your email address with third parties for marketing purposes.

8. Third-Party Links & Services

The Service may contain links to third-party websites or integrate with third-party services (such as Apple Music or Spotify). We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is governed by their respective terms.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Sahtu Press, Inc. and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notice or by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of California.
